As an important aspect of the Cayman Islands' status as a tax neutral, sophisticated, international, offshore centre, many corporations, businesses, transactional and investment vehicles/SPV's are either registered in the Cayman Islands or are part of a group structure which has ultimate or intermediate holding companies registered here.
As a result of factors including adverse movements in financial markets, disputes, trading difficulties, regulatory intervention, creditor pressure and political instability, members of the firm are regularly involved in advising on multi-jurisdictional, cross border insolvency and restructuring issues.
The firm's experience includes acting for local and overseas insolvency professionals, trustees in bankruptcy, administrators, receivers, liquidators and creditors. We are experienced in advising local and overseas professional clients on how to handle and co-ordinate cross-border appointments, freeze assets, gather information and evidence and in particular obtaining recognition and assistance for local professional clients from overseas courts under legislation such as the US Federal Bankruptcy Code and the UK Insolvency Act. The firm also handles litigation and disputes arising from the inception of insolvency along with local and international claims initiated by office holders against third parties, former management and debtors.
